Terms of Service

The agreement between your business and BEPO Services LLC.

Effective August 17, 2026

These Terms govern your use of Serve Well POS, a point-of-sale service operated by BEPO Services LLC (“BEPO,” “we,” “us”). By creating an account or using the app, you agree to them on behalf of your business.

The service

Serve Well POS lets a business take orders, manage a catalog, route tickets to the kitchen, run table service, sell event tickets, accept card payments, and see its own reporting. Features available to you depend on the plan you select.

Accounts and staff

  • You must provide accurate business information and keep it current.
  • You are responsible for the accounts you create for your staff and for what those accounts do.
  • Assign the lowest role that lets each person do their job, and disable accounts when someone leaves.
  • Keep your credentials confidential. Tell us promptly if you believe an account has been compromised.

Subscriptions, trials, and billing

  • Plans are priced per location and billed monthly in advance, in U.S. dollars, through Stripe.
  • New accounts include a 14-day free trial. If you do not cancel before the trial ends, your subscription begins and the plan fee is charged.
  • Subscriptions renew automatically each month until you cancel.
  • You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are not refunded except where required by law.
  • We may change plan pricing with at least 30 days’ notice before it applies to your next renewal.
We do not mark up your card processing. Card payments run through your own Stripe account at Stripe’s standard rates and settle directly to you. BEPO takes no percentage of your sales. Any hardware we recommend is bought by you, from the manufacturer or a retailer — we do not resell it.

Payment processing

Card acceptance is provided by Stripe under your own agreement with Stripe, and is subject to Stripe’s terms. Settlement, chargebacks, disputes, holds, and payout timing are governed by that agreement and are between you and Stripe. BEPO is not a party to your transactions with your customers and is not a payment processor, money transmitter, or merchant of record.

Your data

Your business data — your catalog, orders, sales history, and staff records — belongs to you. We store and process it to operate the service for you, as described in our Privacy Policy. You are responsible for the accuracy of what you enter and for complying with the laws that apply to your business, including tax collection and reporting, receipt and record-keeping rules, and any rules that apply to the goods you sell.

Acceptable use

You agree not to:

  • use the service for anything unlawful, or to sell goods or services you are not permitted to sell;
  • attempt to access another business’s data, or probe, scan, or interfere with the service’s security;
  • reverse engineer, copy, resell, or sublicense the service;
  • upload malicious code, or use the service in a way that degrades it for others.

Availability and support

We work hard to keep the service running, but we do not promise uninterrupted availability. Planned maintenance, third-party outages (including Stripe, Supabase, and hosting providers), and events outside our control can interrupt service. Support is provided through the app and by email at the address below.

Suspension and termination

You may stop using the service at any time. We may suspend or terminate an account for non-payment, for a breach of these Terms, or where required by law — with notice where practicable, and immediately where the situation is urgent. On termination we will make your business data available to you for a reasonable period before deletion.

Disclaimers

The service is provided “as is” and “as available.” To the fullest extent permitted by law, BEPO disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not provide legal, tax, or accounting advice; reporting features are tools, not a substitute for your accountant.

Limitation of liability

To the fullest extent permitted by law, BEPO will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim arising out of or relating to the service is limited to the amount you paid us for the service in the twelve months before the event giving rise to the claim.

Changes to these Terms

We may update these Terms. If a change is material, we will update the effective date above and notify you in the app or by email before it takes effect. Continuing to use the service after that means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The state and federal courts located in Texas will have exclusive jurisdiction over any dispute.
